This document outlines the terms and conditions, as well as the privacy policies, that apply to the use of services provided by SHOP PETRA on its website www.shoppetra.com and other related domains. Any person who subscribes to www.shoppetra.com or wishes to use the services is entitled to do so but must agree to abide by the terms and conditions and privacy policies outlined in the “Terms and Conditions” document.
These sales terms and conditions will be governed by the laws of the Republic of Colombia. Any disputes arising from this agreement will be subject to the jurisdiction in accordance with Colombian law, and both SHOP PETRA and the customer agree to waive any other jurisdiction that may correspond to them based on their current or future domicile.
It is mandatory for the user to READ, UNDERSTAND, and ACCEPT all the conditions set forth in this document before Sing Uping as a user or purchasing products or services through www.shoppetra.com. By using this site, the user is fully accepting the conditions established in the Terms and Conditions and the Privacy Policies of SHOP PETRA. Therefore, the user must comply with all the pre-established conditions and cannot claim ignorance of such Terms and Conditions and Privacy Policies.

SECTION 1 – LEGAL CAPACITY

The services provided by SHOP PETRA are only available to individuals who have the legal capacity to contract. Any actions carried out by minors on this site will be the responsibility of their parents or guardians, and will therefore be considered to have been performed by them under their legal representation. In addition, any company Sing Uping must have the full capacity to contract on behalf of the entity and, as such, will be bound by the terms outlined in the “Terms and Conditions” document.

SECTION 2 – REGISTRATION AND SITE USAGE

To become an authorized user of www.shoppetra.com, purchase products, and access promotions offered on site, you must complete the registration form with valid, accurate, and truthful data in all mandatory fields. You agree to update your personal information used when completing the registration form as needed.
SHOP PETRA is not responsible for the accuracy of personal data provided by its users. Each user is accountable for the accuracy and truthfulness of the personal data entered into the system. Moreover, each natural and/or legal person may only have one account on www.shoppetra.com. If you modify or alter your data in any way to access more than one account and fraudulent or malicious use is suspected or confirmed, www.shoppetra.com has the unappealable right to terminate your credits, disable your account in the system, and pursue legal action against you. SHOP PETRA has the right to request additional data or proof to verify the personal data provided by users. It also has the right to temporarily or permanently suspend users whose data is not confirmed and who refuse to provide requested additional data or proof. If you are suspended, SHOP PETRA may retract a purchase made by you without the right to compensation.
When new members Sing Up, they will receive their email address or username and a personal password that allows confidential and secure access to the www.shoppetra.com page. You are fully responsible for maintaining the confidentiality of your password, as it enables you to make purchases and obtain personal information. Giving your personal password to third parties does not involve SHOP PETRA’s responsibility. You are responsible for all operations carried out from your account, and your access password must be for personal and exclusive use. It is your responsibility to immediately notify SHOP PETRA of any unauthorized use of your account or password. Selling, lending, or transferring passwords or accounts between users is strictly prohibited. SHOP PETRA reserves the right to reject any registration request or cancel a previously accepted registration without being obligated to provide reasons for its decision and without generating any right to compensation.

SECTION 3 – AGREEMENT MODIFICATIONS

SHOP PETRA may modify the Terms and Conditions at any time. The modified terms will take effect 10 days after their publication. Within the first 5 days after publishing the new modifications, you must contact www.shoppetra.com by email if you do not accept the new Terms and Conditions. In the event you do not accept them, your membership will be disabled. If the 5-day period expires, it will be considered that you accept the new Terms and Conditions, and the contract between both parties will not be affected.

SECTION 4 – PAYMENT METHOD

The products and services offered on www.shoppetra.com can only be paid for using the payment methods indicated in each specific case. The use of a credit card is subject to the provisions in these Terms and Conditions and the agreements in the respective opening contracts and usage regulations with the card issuer. SHOP PETRA may determine purchase conditions according to the payment method chosen by you. SHOP PETRA has the right to determine the maximum amount of credits that you can use per purchase, and you will be notified before starting the payment process. Credits used by you will not be refunded in the event of product returns.

SECTION 5 – CONSENT FORMATION IN CONTRACTS MADE THROUGH THIS SITE

Through www.shoppetra.com, offers of goods and services are made. The acceptance of an offer by you is subject to a suspensive condition until the transaction is valid. For every operation carried out on www.shoppetra.com, the provider’s validation is a requirement for the formation of consent. To validate each transaction, it must first be verified that the payment method offered by you is valid, the data entered by you on the site matches what was provided when the offer was accepted, and that payment is credited by you. To inform you about the offer validation, a written confirmation will be sent to the email address Sing Uped by you upon subscribing. Consent will be deemed formed from the moment this written confirmation is sent to you and in the place where it was issued. The sale and delivery of products are subject to their availability. If a product is not available for purchase, the customer will be immediately notified and receive a full refund.

Section 6 - Validity Period of the Offer and Price

Offers on www.shoppetra.com will be valid until the expiration date specified in the promotion or until the quantities of products available for that promotion are exhausted. If there is no expiration date indicated in a promotion, it will be understood that the offer will exist until the corresponding inventories are exhausted. The prices of the products and services published on www.shoppetra.com are only valid for purchases made through this medium and are not applicable for other sales channels. All prices are expressed in Colombian pesos. Transportation, handling, shipping costs, and accessories not expressly described in the product descriptions are not included in the prices offered. Some products may have incorrect prices. In case of identification of any typographical error in any of the product prices, customers will be contacted before the products are shipped, and they will be notified of the error. The products will not be shipped until the correct price is paid.

Section 7 - Promotions

Promotions offered on www.shoppetra.com are not valid in other sales channels. When promotions consist of reducing the price or sending a product for free with the purchase of another, both products must be delivered to the same location. Suppliers subject their promotions to the provisions of Law 1480 of 2011. When discount coupons are offered, the coupon value, the minimum purchase amount required to use the coupon, and the dates when it can be used will be specified. Coupons can be used by any natural person over 18 years of age. Coupons cannot be combined with other promotions and can only be used once per customer. The maximum purchase amount for coupon use is 1 million Colombian pesos.

Section 8 - Product Delivery

Products purchased through our Marketplace are subject to the dispatch conditions chosen by the user, and the delivery conditions available in our Marketplace. The user can freely choose the delivery address.

Once the payment is approved and the order is dispatched, PETRA will communicate the delivery date to the customer by email.
If no one receives the order at the delivery address, a second attempt will be made in the following three days. If after this attempt no one receives the order, the user should contact our Marketplace by email: hola@shoppetra.com. The customer then bears the cost of the new shipment. If the customer does not arrange for a new shipment within the following 5 days after the second attempt, the product is marked as abandoned, and there will be no compensation. In such cases, PETRA is not responsible for non-delivered products. If the customer chooses payment upon delivery, and does not pay the full amount for the product and the predefined shipping cost; it is understood that there is a breach of contract, and the customer must pay for returning the products.
It is understood that anyone present at the delivery address specified by the customer, is authorized to receive the order; therefore, PETRA is exempt from any claims arising from the delivery made at the location designated by the customer.

Section 9 - Returns and Cancellations Policy

Returns or Refunds (Right of Withdrawal)
SHOP PETRA offers its customers the possibility to withdraw from the purchase during the first 3 business days after product delivery. The process for requesting a withdrawal is as follows:
 
  • Send an email within 3 business days of receiving the product to hola@shoppetra.com with the reason for the return and whether you require the same product, a different one, or a refund. Note: It is important to be very specific about the reasons for the return.
  • Once the email is reviewed by SHOP PETRA, the customer will receive an email with a reverse logistics guide.
  • The customer has 3 days after receiving the reverse logistics guide to take the product to the address specified by SHOP PETRA.
  • The product must be in perfect condition and its original packaging, including all packaging and labels.
  • When the product is received, the provider performs quality control that takes approximately 3 business days. Once the product’s condition is determined and the change or refund is authorized, the chosen option by the customer will be processed.
  • Money refunds will only be made by bank deposit to the account specified by the customer.
Wrong Products
If the customer receives a product with characteristics different from what was described on the website at the time of purchase, the procedure for requesting a product exchange is as follows:
  • Within 2 days of receiving the product, the customer must take photos showing the wrong product and send them to hola@shoppetra.com along with the order number.
  • Once it is confirmed that the product was received incorrectly, a collection guide will be sent to the customer, and SHOP PETRA will arrange for the collection of the wrong product at the same location where it was delivered.
  • After collecting the wrong product, the correct product will be sent.
Cancellations
If the provider is unable to send a product to the customer due to a lack of inventory or other reasons beyond their control, the purchase will be canceled. In such a case, the customer will be notified and the refund will be processed. The time it takes for the refund to be processed varies depending on the payment method used. Customers can choose one of the following refund methods:
  • Voucher: Vouchers are valid for one year and can only be used in a single purchase. The delivery time for this refund is 2 business days.
  • Bank Deposit: The refund will be processed in 3 business days and the account holder must be the same as the one who made the purchase from www.shoppetra.com
To cancel an order for any reason, the customer needs to send an email to hola@shoppetra.com with the order number they wish to cancel. Orders can only be cancelled if they have not yet been shipped by the provider. In case of payment through the PayU payment gateway, the customer assumes the commission costs generated.

SECTION 10 - INTELLECTUAL AND INDUSTRIAL PROPERTY

All the content that is accessible to the user on www.shoppetra.com, including intellectual and industrial property, is exclusively owned by SHOP PETRA or the companies that supply the products. Users are required to refrain from reusing any of the content available on www.shoppetra.com without the prior consent of SHOP PETRA.

SECTION 11 - THIRD-PARTY INTELLECTUAL PROPERTY

SHOP PETRA provides tools that guarantee the authenticity of products purchased through its services and ensures that they have been legally imported into the country. In case a user suspects any infringement of intellectual property or legal rights with regards to a product listed on www.shoppetra.com, they can report it to hola@shoppetra.com for review.

SECTION 12 - RESPONSIBILITIES

Please note that SHOP PETRA cannot be held responsible for any losses in business opportunities or any indirect damages caused by interruptions in site transmission. While we make every effort to ensure that transmission is error-free and uninterrupted, we cannot guarantee such conditions. Please be aware that user accounts may be temporarily suspended or restricted for maintenance purposes or to make improvements to the site.

SECTION 13 - NOTIFICATIONS

Concerns regarding the Terms and Conditions or the Privacy Policy must be submitted in writing to SHOP PETRA at hola@shoppetra.com.
